TERMS AND CONDITIONS OF SALE

These terms and conditions govern the purchase of all Objects (Art, Decor, sculptures, Original prints, and Collectibles) on jambudweep.co. By placing an order, the Buyer agrees to be bound by these provisions.

  1. DEFINITIONS

    • “Jambudweep”: Refers to Jambudweep Art Collective Pvt. Ltd.

    • “Object”: Any item of art, furniture, home décor, or collectible listed for sale on the Website.

    • “Buyer”: The individual or entity registered on the Website who purchases an Object.

    • “Description”: Detailed information about the Object, including artist/maker, dimensions, materials, age, and a description of its physical condition.

  2. PRICING, TAXES, AND CURRENCY

    • Fixed Price: All Objects are sold at the price listed on the Website. Prices are non-negotiable unless a specific “Make an Offer” feature is enabled for that item.

    • Taxes and Duties: For sales within India, GST will be added to the listed price as per the applicable slab. For international orders, the Buyer is solely responsible for all Import Duties, Customs, and Local Taxes in their respective country.

    • International Rates: For international convenience, prices may be displayed in USD. Jambudweep uses a standard conversion rate of 84 INR. Final billing will occur in INR (Indian Rupees) unless otherwise agreed.

  3. THE PURCHASE PROCESS

    • Contract Formation: A purchase order on jambudweep.co is an offer by the Buyer to purchase. The contract of sale is concluded only when Jambudweep sends a written Order Confirmation email.

    • Possession: Objects may not be in the physical possession of Jambudweep and may be shipped directly from the Artist’s studio or a partner gallery.

    • Right to Refuse: Jambudweep reserves the right to cancel any order at its discretion—specifically in cases of inventory errors, suspected fraud, or pricing glitches—and will provide a full refund in such instances.

  4. PAYMENT AND BILLING

    • Method: Payments are accepted via Credit/Debit Cards, Net Banking, and UPI through our secure gateways.

    • Deadline: Full payment, including shipping and taxes, must be received within 24 hours of the order being placed. If payment is not realized, the item will be released back into the public inventory.

    • Invoicing: Invoices are generated based on the name and address provided during registration. No changes to the billing name can be made after the invoice is generated.

  5. SHIPPING, HANDLING, AND INSURANCE

    • Professional Packing: Due to the fragile nature of art and collectibles, Jambudweep uses specialized packing.

    • Shipping Costs: These are calculated based on the volumetric weight and the delicacy of the item.

    • Transit Insurance: All shipments are covered by transit insurance. In the rare event of damage during transit, Jambudweep will manage the insurance claim process on behalf of the Buyer, provided the damage is reported within the stipulated timeframe.

  6. CONDITION AND PREVIEW

    1. “As-Is” Sale: Many Objects are unique, vintage, or handmade. Minor variations in color or texture as seen on screen versus reality are expected.

    2. Condition Reports: Detailed condition reports are available upon request for high-value items.

    3. Physical Previews: Previews are by appointment only and are subject to the physical location of the Object.

This version incorporates the specific, high-touch philosophy of Jambudweep — focusing on pre-purchase confidence and a “no-returns” policy due to the fragile/unique nature of the collection—while maintaining the legal structure of Jambudweep Art Collective Pvt. Ltd.
